Terms of Service

1. Services

Bisai Technologies provides custom mobile application design and development services for iOS and Android, including related design, backend, integration, store-submission, and support services. The exact scope, deliverables, timeline, and total price for your project are defined in a written proposal or statement of work agreed between you and us before work begins.

2. Pricing and plans

Our published plans (Launch, Growth, and Scale) describe representative scopes and starting prices. Final pricing depends on the agreed scope of your project. All prices are stated in U.S. dollars (USD).

3. Deposits and payment

To reserve a project, we collect a clearly-labeled booking deposit through our payment processor, Stripe. The deposit is credited in full toward your project total. The remaining balance is invoiced as work proceeds, according to the milestones in your statement of work. Refunds of deposits are governed by our Refund Policy.

4. Client responsibilities

• Provide timely feedback, content, accounts, and materials necessary for us to perform the services.
• Ensure you have the rights to any content, trademarks, or assets you provide to us.
• Comply with all applicable Apple App Store and Google Play policies and all applicable laws.

5. Intellectual property

Upon full payment for the applicable milestone or project, you own the deliverables we create specifically for you. We retain ownership of our pre-existing tools, libraries, and general know-how, and we may reference completed work in our portfolio unless you request otherwise in writing.

6. Third-party services

Projects may rely on third-party platforms (for example Apple, Google, Stripe, or hosting providers). Your use of those services is subject to their terms, and we are not responsible for their availability or actions.

7. Warranties and disclaimers

We perform our services in a professional and workmanlike manner. Except as expressly stated, our website and services are provided "as is" without warranties of any kind, to the maximum extent permitted by law. We do not guarantee specific business results, app-store approval timelines, or download numbers.

8. Limitation of liability

To the maximum extent permitted by law, Bisai Technologies's total liability arising out of or related to the services will not exceed the amounts you paid to us for the project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

Either party may terminate an engagement in writing. On termination, you will pay for work performed up to the termination date, and we will deliver completed, paid-for work.

10. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.
